3. Intellectual property
All the content of this website (text, images, trade mark, logo and graphic elements) is protected by copyright. The name and the logo of Clinique Paul Niehans may not be reproduced without prior written authorisation. Any reproduction, even in part, is subject to the clinic's agreement.
4. Medical information
The information published on this website is provided for general information purposes. It constitutes neither a diagnosis, nor a promise of results, nor a substitute for a medical consultation. Every indication, contraindication and treatment arrangement is determined on an individual basis by a doctor of the clinic, following an admission assessment.
5. Liability
The clinic takes the greatest care over the accuracy of the information published, without being able to guarantee that it is free from error or fully up to date. It cannot be held liable for any damage resulting from access to the website or from its use. Third-party websites reached through a link from this website are the sole responsibility of their publishers.
6. Data controller
The controller within the meaning of the nLPD is Clinique Paul Niehans SA, at the address given under point 1. Any question relating to data protection may be sent to infos@paulniehans.ch.
7. Data we process
When you use the contact form, we record the information you enter: surname and first name, e-mail address, preferred call-back language, call-back time slot, the content of your message, and the page from which the request was sent.
When you simply browse the website, our host records technical data necessary for the operation and the security of the service (IP address, date and time of the request, pages viewed, browser type).
We use no audience-measurement tools and no advertising networks. The website sets a single technical cookie, intended to remember the language you have chosen.
The Contact page displays a Google Maps plan. When it loads, Google LLC receives your IP address and may set its own cookies, under its privacy policy. Google is the only third-party service present on this website; no other page calls upon it.
8. Health data
Data relating to health are sensitive data within the meaning of the nLPD and benefit from enhanced protection. We ask you not to send medical information through the contact form: a medical questionnaire will be sent to you separately, in an appropriate setting. The medical information that you subsequently entrust to the clinic is covered by medical confidentiality (Article 321 of the Swiss Criminal Code) and is accessible only to the healthcare professionals concerned.
The admission file — registration form, medical questionnaire and consent — is completed online, through a personal link sent to you by the clinic. Your answers are transmitted encrypted, stored encrypted on our servers in Switzerland and accessible only to the clinic's authorised medical and administrative staff; every access is logged. They form part of your medical record.
9. Purposes and legal bases of processing
Your data are processed in order to respond to your request, to arrange your visit and your stay, to provide the medical and administrative follow-up arising from it, and to comply with our legal obligations. Depending on the case, this processing is based on your consent, on the performance or the preparation of a contract, or on a legal obligation.
10. Recipients
Your data are accessible to the staff of the clinic who need them in order to deal with your request. They are hosted by our technical service provider (point 2), which acts as a processor and is bound by confidentiality. We neither sell nor rent your data, and we do not pass them on for any commercial purpose. Disclosure to a third party (for example a treating doctor or a partner establishment) takes place only with your agreement or where the law so requires.
11. Transfers abroad
The website's data are hosted in Switzerland and are not transferred abroad. Should such a transfer become necessary, it would be carried out only to a country offering adequate protection or subject to appropriate contractual safeguards.
12. Retention periods
Requests received through the contact form are kept for twelve months from the last exchange, then deleted. If a request leads to a stay, the information joins the medical record and follows the retention periods applicable to it. Accounting records are kept for ten years, in accordance with art. 958f of the Swiss Code of Obligations.
13. Security
The website is served over HTTPS and access to the administration area is restricted to authorised persons. We take appropriate technical and organisational measures to protect your data against any unauthorised access, loss or use.
14. Your rights
You have a right of access to your data, and rights of rectification, erasure, objection to processing and, where applicable, portability. You may also withdraw a consent you have given at any time. To exercise these rights, please write to us at infos@paulniehans.ch ; nous pourrons vous demander un justificatif d'identité afin d'éviter toute divulgation à un tiers.
15. Complaints
If you consider that the processing of your data does not comply with the law, you may contact the Federal Data Protection and Information Commissioner (PFPDT), Feldeggweg 1, 3003 Berne.
16. Governing law
This website and the processing described are subject to Swiss law. The place of jurisdiction is Vevey, subject to the mandatory places of jurisdiction provided for by law. If you reside in the European Union, the rights you hold under the GDPR remain reserved.
